Welcome to Omniva Travel (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and travel booking assistance.
By accessing our website, making a booking, or scheduling a consultation, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Scope of Services & Role as an Agent
Omniva Travel acts strictly as an independent travel agency and booking agent. We facilitate bookings for travel products including, but not limited to, flights, cruises, resort packages, tours, and custom itineraries (“Travel Services”) provided by third-party suppliers (e.g., airlines, cruise lines, hotels, tour operators, and transportation providers, collectively “Suppliers”).
- Third-Party Contracts: All travel bookings made through Omniva Travel are subject to the terms, conditions, cancellation policies, and liability limitations imposed by the respective Third-Party Suppliers.
- No Direct Control: Omniva Travel does not own, manage, or operate any flights, ships, hotels, or transportation services.
2. Booking, Deposits, and Payment Terms
- Quotes and Rates: All prices displayed on the Site or provided during consultations are listed in U.S. Dollars (USD) unless explicitly stated otherwise. Prices are subject to availability and supplier rate changes until a booking is finalized and confirmed.
- Deposits and Final Payment: Deposit requirements, final payment deadlines, and booking fees will be specified at the time of reservation. Failure to make payments by the designated due date may result in automatic cancellation of your reservation by the Supplier, and initial deposits may be non-refundable.
- Promotions & Offers: Special offers, instant savings, or “Extra Guests Sail Free” promotions are subject to supplier availability, capacity limits, and specific blackout dates. Promoted savings apply to specific cabin categories or itinerary types as determined by the Supplier.
3. Cancellations, Modifications, and Refunds
- Supplier Cancellation Policies: Cancellations and modifications are strictly governed by the specific rules of the applicable Supplier. Some bookings, including non-refundable deposit fares, may incur supplier-imposed change or cancellation fees.
- Agency Service Fees: Omniva Travel reserves the right to charge professional service or administrative processing fees for handling complex trip modifications or cancellations. Any administrative fees charged by Omniva Travel are separate from Supplier penalties and are non-refundable.
4. Passports, Visas, and Travel Documentation
- Client Responsibility: It is the sole responsibility of the traveler to obtain, hold, and present all valid travel documentation required by applicable authorities, including valid passports, entry visas, health declarations, and re-entry permits.
- Passport Validity: Most international destinations require passports to be valid for at least six (6) months beyond your scheduled return date.
- Travel Advisories: Prior to booking, we strongly advise reviewing official travel advisories issued by the U.S. Department of State and the U.S. Centers for Disease Control and Prevention (CDC) regarding health, safety, and entry mandates. Omniva Travel is not liable for travel disruptions or denied boarding resulting from missing or invalid travel documents.
5. Travel Insurance Recommendation
Omniva Travel strongly recommends purchasing comprehensive Travel Insurance to protect your investment. Travel insurance can cover unexpected risks, including trip cancellations, medical emergencies, flight interruptions, baggage loss, or emergency evacuations. If you elect to decline travel protection, you acknowledge and accept personal financial responsibility for any unexpected losses or expenses incurred.
6. Limitation of Liability & Supplier Actions
- Acts of Third Parties: Omniva Travel is not liable for any acts, omissions, errors, warranties, breaches, negligence, or misconduct of any Third-Party Supplier, nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
- Force Majeure: Omniva Travel is not liable for delays, cancellations, itinerary changes, or losses caused by events beyond reasonable control, including but not limited to weather anomalies, natural disasters, acts of God, pandemics, strikes, civil unrest, or government restrictions.
7. Intellectual Property
All content on this Site—including logos, taglines, text, custom images, graphics, and underlying code—is the property of Omniva Travel or its content suppliers and is protected by United States copyright, trademark, and intellectual property laws. Unauthorized copying, modification, or distribution of site content is strictly prohibited.
8. User Conduct & Site Use
You agree to use this Site solely for legitimate travel inquiries, bookings, or consultations. You agree not to make speculative, false, or fraudulent inquiries, or to submit false contact details through our lead forms or booking tools.
9. State Seller of Travel Disclosures (US Compliance)
Where applicable under U.S. state law (e.g., California, Florida, Hawaii, Washington), Omniva Travel complies with state Seller of Travel (SOT) registration standards. Relevant registration numbers will be provided on booking confirmation receipts where required by law.
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States and the State in which Omniva Travel is registered, without regard to conflict of law principles. Any legal action or dispute arising under these Terms shall be resolved exclusively in the state or federal courts located within our primary jurisdiction.
11. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time without prior written notice. Updates will take effect immediately upon being posted on the Site. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
